Law
contains the system that a society has, so it is a firm basis for maintaining
the society. Actually, the law has been changed as the system of a society has
been revolutionized. It means law is needed to be malleable in various
circumstances, times, and places. I also agree with the statement but there
should be a certain degree that makes the law flexible because of possible
dangers when the law is very flexible.
First,
law is required to be evolutionized as time goes by. To be specific, social
norms and rules in a society have been changed or the society itself has been
created and vanished over the time. Therefore, a law, a backbone of a society
which has fundamental ideologies and norms in the society, need not be
stationed. Recently, for example, the government-aid free meal in elementary
school of South Korea was initiated by Parliament. Since Korean governments had
focused their primary concerns on economic growth over social welfare, a
limited portion of government budget was spent on the social welfare problems.
However, as the many residents in the country have had more concerns on their
well-being and disputed incessantly, a legislation that guarantees a minimum
level of free meal in elementary school could be passed by the Parliament.
Secondly,
even if I claim that the law should be flexible in terms of various
circumstances, times and places, we should confine a certain level of
flexibility in the law. Specifically, if we do not guarantee a certain rigidity
of the law, this may harm the security system of a society. To illustrate this,
we think of the education policy in South Korea. In the country, people put
their value significantly on education and, as a result, policies for education
frequently are changing over the time. Especially, as new governments come into
power, the frequency arises. The problem is that students who expect to enter
university feel infringed due to the changing policies.
In
sum, I think flexibility in law is required for some degree because the law
should reflect a society which changes as time goes by. However, if the level
of rigidity in law is way too low, the secure system of the society will also
get damaged. |
